Battle Born Progress Reacts to Supreme Court Decision in Trump Immunity Case
LAS VEGAS, NV – Today, the United States Supreme Court issued a decision in the Trump v. United States case, which sought to address the scope of former President Donald Trump’s presidential immunity during his term as President. The court decided 6-3 to kick this case back down to the lower courts under a new definition of presidential immunity for “official acts,” with no such immunity for “unofficial acts” and rejecting Trump’s broadest claims of total presidential immunity. By punting the case back to the lower court, the Supreme Court has all but guaranteed there will be no decision in the January 6 case for Donald Trump before November’s election.
Shelbie Swartz, Executive Director, of Battle Born Progress, issued the following statement:
“Today’s decision is not only craven and short-sighted, but opens us up to severe consequences in future presidencies. If the President of the United States is above the law – even if only for ‘official acts’ – we are in big trouble as Trump mounts his run for a second term. The fuzzy line between ‘official act’ and ‘unofficial act’ will not save our democracy from those who would degrade or destroy it. It is our belief that no one is above the law. However, the highest court in the land clearly disagreed when the very president on trial appointed three of them to their positions. Presidents should be subject to the same laws as the rest of us, with the same shot at a fair trial. Immunity is no defense for Trump’s wrongdoings, immunity ignores the law. The current Supreme Court is out of touch with the American people, evidenced by their rulings which undermine our freedoms and our democracy. Today is a sad day for Americans who want – and who deserve – justice, fairness and equality.”
